Golden Bull · Promulgated on 30 December 2025
Paragraph 1 On the Privilege of Express Declaration and Its Scope
At any time, should Our Reichstag, or the Great Council lawfully assembled in any province, principality or territory, in the course of its session, in response to the welfare, the defence or an irresistible emergency of the Empire or of the territory, declare beyond controversy, by express proclamation to all the world in a formal statute promulgated by it, that the statute, whether in whole or in specific provisions, shall be free from the constraints of theBasic Law of the Empirein respect of the fundamental rights of subjects and secular equality set out therein, and may be carried on and given effect within the realm as usual.
A declaration as provided in the preceding paragraph shall, upon countersignature by the Imperial Chancellor and submission to the Kaiser for sealing and sanction, be deemed lawful and of adjudicative force. No court or judge may declare such a statute void on the ground of the provisions of the Basic Law from which exemption has been granted.
No such declaration shall ever be used to alter, suspend or infringe the dignity of the Kaiser, the imperial succession in law, or the core constitutional order of the Basic Law of the Empire.
Paragraph 2 On the Effect of Statutes under a Privilege Declaration
Every statute that follows from the provisions of Paragraph 1 above and has been duly sealed and brought into force within the Empire or a constituent State shall, during the period of validity expressly declared, be given effect in its governing, binding and adjudicative force without any impairment whatsoever; its force shall be as sacred and complete as if the provisions of the Basic Law from which exemption has been granted had never existed, and all subjects within the realm, high and low, shall reverently obey it.
Paragraph 3 On Expiry after Nine Months and the Limitation of Automatic Termination
Yet the way of Heaven moves in cycles, and every law made by man has its end. A privilege declaration made under Paragraph 1 above shall, as from the day of its formal sealing, drying and public reading, upon the lapse of nine months by the calendar, or on the earlier date expressly stated in the declaration itself, forthwith dissolve into nothing and cease to have any effect.
Thereafter, the provisions of the Basic Law that were temporarily suspended shall again shine forth in their full vigour, and may not be continued otherwise than by the reconfirmation hereinafter provided.
Paragraph 4 On Reconfirmation and Continuation after Expiry
If, upon the expiry of the nine months, the Reichstag or the council of any constituent territory, after deliberation by the princes or their representatives, considers that the emergency aforesaid has not receded, or that the maintenance of the statute remains necessary in the supreme interest of the territory, that council may, in accordance with the same procedure laid down in Paragraph 1 above, again vote, submit the matter for sealing and promulgate a new edict in order to reconfirm and continue the effect of the privilege declaration.
Paragraph 5 On the Time Limit Imposed upon Reconfirmation and Judicial Supervision
In order to guard against the usurpation of power and against endless tyranny, every edict of reconfirmation and continuation provided for in Paragraph 4 above must likewise submit unconditionally to the “nine months” fetter of time set out in Paragraph 3. Upon expiry, the declaration shall again become void unless the statutory procedure is once more observed.
The Privy Court may at any time adjudicate upon the procedural legality of a privilege declaration and upon whether its term has expired, so as to manifest the enduring justice and rule of law of the Empire.
